Send a letter before action
You have asked three times, been ignored three times, and the next email will be ignored too.
For anyone owed money or owed performance who wants to be taken seriously before going anywhere near a court.
A letter before action is the step the court expects you to take first, and it is also the cheapest thing that works. A large share of disputes settle at this point, because it is the first message that reads like the sender has actually read the rules.
The reason it works is not the tone. It is that it sets out the facts, the legal basis, the sum, the deadline and the consequence, in a form the recipient can see has been done properly.
What we do
- The letter drafted to the relevant pre-action protocol, or to the Practice Direction where no protocol applies.
- The claim set out: what happened, what you are owed, how it is calculated, and what you want done.
- A deadline that is reasonable in the circumstances, because an unreasonable one is held against you later.
- The documents you should enclose, and the ones you should not.
- A short note on what to do with each of the likely replies, including silence.
What it costs
Priced per letter, on the complexity of the dispute rather than the sum involved.
Whatever the figure is, you have it in writing before any work starts, and it does not move afterwards.
Where the limits are
- We draft the letter and you send it, so the correspondence stays in your name.
- If it does not work and you want to issue a claim, we prepare it and you file it. We do not conduct litigation.
