Set aside or remove a County Court Judgment
A credit check came back with a judgment on it, and you either never saw the claim or you have already paid.
For anyone who has found a County Court Judgment against them, whether they knew about it or not, and wants it gone or corrected.
A County Court Judgment sits on the Register of Judgments for six years and follows you through every credit decision in that time. There is more than one way off it, and which one applies to you decides everything about what happens next.
If the claim never reached you, or you have a real defence, the judgment can be set aside. If you paid in full within a month of the judgment, it can be cancelled and removed entirely. If you paid later, it can be marked satisfied, which still shows but reads very differently to a lender. We work out which of those you are, then prepare it.
What we do
- We establish which route is open to you: set aside, cancellation, or marking it satisfied.
- For a set-aside, the application notice and your witness statement drafted, covering both limbs the court looks at: why you did not respond, and what your defence actually is.
- For cancellation or satisfaction, the certificate application prepared with the proof of payment the court will want.
- The evidence bundle assembled and indexed in the order the court reads it.
- A plain note on what happens after, including how long the register takes to update and what to tell a lender in the meantime.
What it costs
Priced on which route applies and how much evidence it needs. Quoted in writing once we have seen the judgment. Court fees are separate and paid by you to the court.
Whatever the figure is, you have it in writing before any work starts, and it does not move afterwards.
Where the limits are
- You file the application and attend any hearing. We prepare everything you file. That division is why this costs a fraction of instructing a firm to run it for you.
- Setting aside a judgment is the court’s decision and it is discretionary. Nobody can promise you an outcome, and anyone who does is selling you something.
- There is a court fee payable on an application to set aside, separate from anything we charge.
